General Terms and Conditions of Sale

Article 1 – Purpose

This swimwear website is maintained by La Caravelle™, a company registered with the Strasbourg Trade and Companies Register.
We kindly ask you to carefully read these terms and conditions. By using this website, you fully and unconditionally agree to La Caravelle’s General Terms and Conditions of Sale. If you disagree with any provision, we invite you not to use this website. La Caravelle reserves the right to modify these terms at any time without notifying its visitors or customers. We therefore recommend regularly checking this section. Under no circumstances shall La Caravelle be directly or indirectly liable for any losses or damages of any kind related to the use of this website.

Article 2 – Prices

For customers based in the European Union, product prices are indicated inclusive of all taxes (VAT and any other applicable taxes on the day of the order), unless otherwise stated, excluding shipping costs.
For customers based outside the European Union, product prices are duty-free. For orders shipped outside the European Union, the customer is legally considered the importer. Local VAT, customs duties, and other taxes may be required by local authorities. These potential taxes and additional fees are entirely the responsibility of the customer, who is solely accountable for the imported goods. We recommend contacting your local customs authorities for further information.
All orders are payable in euros, dollars, and other currencies listed in Article 5 (Payment).
La Caravelle reserves the right to modify its prices at any time. However, the price paid by the customer is the one displayed in the online store at the time of placing the order, subject to availability.
La Caravelle retains full ownership of all goods until full payment is received from the customer.
Warning: Upon effective possession of an ordered product by the customer, they become responsible for it, and all risks related to loss or damage are transferred to them.

Article 3 – Orders, Pre-orders, Discount Codes, and Gift Cards

ORDERS

To be valid, all orders must be placed on this website.
However, an order may be placed through another method provided La Caravelle’s written agreement is obtained.
Only the products and their characteristics (appearance, material, composition, colors, etc.) displayed and described on the website are valid. Any visuals or information displayed on other websites or platforms (e.g., Facebook, Instagram, affiliate sites) are not contractual and do not bind La Caravelle.


PRE-ORDERS
If you pre-order an item, it will only be shipped once it has been manufactured by the workshop and delivered to La Caravelle. Delivery times are generally between 6 and 8 weeks and may be subject to change due to manufacturing delays, carrier delivery issues, or force majeure. By pre-ordering, the customer accepts the possibility of delivery later than the dates indicated on the sales pages.


DISCOUNT CODES
Discount codes are applied in the cart, specifically in the field labeled “enter a promo code.” Note that some discount codes require a minimum purchase amount (see Article 9 – Refunds). When applicable, these codes include the mention “minimum amount of …€.”


GIFT CARDS
To use your online credit or gift card, enter your unique code in the “enter a promo code” field in your cart. A gift card is valid for 1 year.
When used, the amount applied will be automatically deducted from your cart total. If you do not use the full credit, the remaining balance will be available for future purchases using the same code. The credit can be applied to shipping costs. Only one promo code can be used per transaction.
Once used, a gift card cannot be refunded, except if it was purchased and used within the 14 days prior and you request a return for a refund. In this case, the used amount will be re-credited to your gift card.

Article 4 – Order Validation

Your use of this website implies your acceptance of the General Terms and Conditions of Sale. Once a product is purchased, you are bound by these terms. All data collected for the transaction is considered valid.
After each validated order, a confirmation email is sent to you.

Article 5 – Payment

By validating your order, you agree to pay the final price displayed. The purchase process is handled by Stripe or PayPal, and the transaction is made by credit card.
In the case of split deliveries in multiple packages, only the shipped products are charged.
This website accepts Visa, MasterCard, American Express, PayPal, and Klarna credit cards. If you wish to pay by another method, please contact us. La Caravelle does not accept all currencies. To check if your currency is accepted, please email us.

Article 6 – Delivery

Items are delivered to the address provided by the customer. The displayed delivery times are indicative only and do not bind La Caravelle. No refund of shipping costs can be claimed in case of delivery delays.
During the purchase process, we invite you to verify the information provided: name, selected item(s), quantity, delivery address, etc. If you have any doubts, feel free to contact us.

Article 7 – Availability

Our items are available for sale as long as they are displayed on this website, subject to stock availability.
In case of product unavailability, the customer is informed within 1 business day by email. Their order is then automatically canceled, and the customer is refunded.

Article 8 – Warranty

La Caravelle only offers new items purchased directly from the manufacturer.
Some items, particularly crocheted ones, may have weaving, color, or print irregularities due to their artisanal nature, but these do not affect their quality.
If an item is found to be defective, La Caravelle guarantees it for 2 years and will refund or exchange it based on the customer’s preference.

Article 9 : Returns, Exchanges, and Refunds

RETURNS

Under Article L.121-21 of the French Consumer Code, La Caravelle offers its customers a 14-day period, starting from the receipt of their order, to request a return or exchange.
The return procedure is detailed in the Shipping and Returns section.

REFUNDS

La Caravelle issues refunds within 7 days, once the return is validated, for the full amount of the ordered item(s) as well as the shipping costs paid by the customer when placing the order.
Express deliveries are refunded at the rate of standard delivery in accordance with current French legislation. Return shipping costs remain the responsibility of the customer.

Special Cases of Partial or Non-Refundable Situations
La Caravelle cannot be held responsible for delivery delays caused by the carrier. No compensation, partial or full, can be claimed in this situation.
Additionally, an order cannot be refunded in the following cases:

  • The returned item is damaged. In this case, a deduction, the amount of which is assessed by La Caravelle, is applied proportional to the degree of damage. If the damage renders the item unsellable, La Caravelle will not issue a refund and will return the item to the customer.
  • The item was customized at the customer’s request, making it unsellable to other customers (e.g., added embellishments, special color, embroidery, etc.).

Article 10 – Liability

The products offered on this website comply with French and European legal requirements. La Caravelle is not subject to the legislation of other countries.
Furthermore, La Caravelle cannot be held liable for damages resulting from the improper use of purchased items.
Finally, La Caravelle’s liability cannot be engaged for any inconveniences or damages caused by the customer’s internet network, including network disruptions, external intrusions, or the presence of computer viruses while browsing this website

Extended Producer Responsibility (EPR) – Unique Identifier (IDU)
In accordance with Article L.541-10-13 of the French Environmental Code, La Caravelle Swimwear is registered with the national producer register managed by ADEME under the following unique identifier:

This identifier certifies compliance with extended producer responsibility obligations.

Article 11 – Applicable Law in Case of Disputes

The language of this contract is French. These terms and conditions of sale are governed by French law. In case of a dispute, depending on its value, only the Strasbourg District Court or Judicial Court (France) has jurisdiction.

Article 12 – Intellectual Property

All elements of the website www.lacaravelle-swimwear.com remain the exclusive intellectual property of La Caravelle. No one is authorized to reproduce, exploit, redistribute, or use, even partially, any elements of the site, whether software, visual, or audio, for any purpose.Roughly 10 sentences summarizing the legal and privacy policies, website usage terms, and terms and conditions for La Caravelle swimwear brand, including shipping, returns, and payment details.

Article 13 – Personal Data

The data recorded on www.lacaravelle-swimwear.com is necessary for managing your account and orders, as well as improving the services and information we provide to you.

This information is also retained for security purposes and to comply with legal and regulatory obligations.
La Caravelle commits to not selling your data to third-party commercial entities. In accordance with the French law of January 6, 1978, you have the right to access, rectify, and object to the personal and nominative information concerning you, directly on the website. Article 14 – Archiving

La Caravelle will archive purchase orders and invoices on a reliable and durable medium, constituting a faithful copy in accordance with Article 1348 of the French Civil Code.
La Caravelle’s computerized records will be considered by all parties involved as proof of communications, orders, payments, and transactions between the parties.
